PACKERS REWARDS PROGRAM TERMS & CONDITIONS

 

The Green Bay Packers Rewards Program ("Rewards Program") is a customer loyalty program offered by Green Bay Packers, Inc., a Wisconsin corporation ("Club") that rewards Rewards Members (as defined below) for participating in Rewards Program activities.

Please read these Terms and Conditions carefully. They contain very important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enroll and participate in the Rewards Program.

NO PURCHASE NECESSARY TO EARN REWARDS POINTS.

1. GENERAL STATEMENT - TERMS AND CONDITIONS

 

By enrolling in the Rewards Program, and by accruing or expending points in the Rewards Program, you acknowledge and agree to be bound by all of the terms and conditions stated herein as well as the Terms and Conditions and the Privacy Policy (defined below) posted on Club's website (www.packersperks.com) and any other rules or terms of which are made available to you in connection with the Rewards Program, each as amended from time to time (collectively the "Terms"). You further agree that the Terms apply to all participation in the Rewards Program and to all points accrued at any time in the Rewards Program, both prospectively and retroactively. If you do not agree to these Terms, you are not eligible to enroll or participate in the Rewards Program.

Club reserves the right to revise or modify the Terms and to terminate the Rewards Program at any time, in any manner, for any reason or no reason, in whole or in part, without prior notice, as outlined below, even though such changes may affect the redemption value of the Rewards Points already accumulated or the availability of redeemable prizes. You agree that you will review the Terms periodically and that you will be bound by the Terms and any modifications hereof.

Club recommends that you bookmark and check this page periodically to ensure that you are familiar with the most current version of the Terms.

 

2. ELIGIBILITY

 

You must be at least eighteen (18) years of age, or the age of majority in the place where you live, whichever is older, at the time of your enrollment as a Rewards Member (defined below). Employees of The Green Bay Packers, the NFL and any of their respective parent companies, subsidiaries, affiliates, agents and agencies that are involved in this program, and the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to redeem prizes. To participate in the Rewards Program you must be a legal resident of the fifty (50) United States (excluding U.S. Territories), have a valid telephone number, and email address. The Rewards Program is provided to individuals only and businesses, corporations, joint ventures, partnerships, groups, associations, and other non-personal entities are not eligible to participate in the Rewards Program. Membership in the Rewards Program is not transferrable.

 

3. HOW TO PARTICIPATE AND CREATE AN ACCOUNT

 

Subject to the eligibility requirements above, you may apply to be a member ("Rewards Member") of the Rewards Program by creating an account ("Account") on the Rewards Program website (www.packersperks.com). To be a Rewards Member, you must provide your full first and last name, telephone number, a valid email address, ZIP code, and create a password. Each email address can only be used for one Rewards Member. You may only enroll in the Rewards Program for yourself, and you may only maintain one Account. By logging into your Account, you can view your account details, current points balance, previous activity, and update personal information and communications preferences. You agree to provide accurate information and to promptly make any changes to your contact information within the Rewards Program. 4. WAIVER OF AND CONSENT TO USE OF CERTAIN PERSONAL INFORMATION

 

Participating in the Rewards Program constitutes your acceptance, permission, irrevocable and unrestricted right for Club and Club's affiliated entities, and their successors and assigns, to use, without compensation or other remuneration to you, your name, picture, image, likeness, actions, social media feeds, location, and other like information generated by you in connection with earning Rewards Points (defined below) for advertising and marketing associated with Club and Club's business activities. Please see the Privacy Policy (defined below) to determine what information may be used by the Club for these purposes.

In connection with your participation in the Rewards Program, you may provide certain information to mobile applications and social media accounts such as Twitter, Facebook, Instagram, and other similar existing or to be developed media methods and, to the extent that you elect to use and participate in such applications and social media, you will be solely responsible for such participation and the disclosure of information provided by you. Club shall have no responsibility for your mobile application and social media participation.

 

5. ACCOUNT AND EARNING REWARDS POINTS

 

A Rewards Member will accumulate points ("Rewards Points") in his or her Account based upon qualifying actions. The list of qualifying actions and associated Rewards Points will be determined in the sole discretion of Club and may be changed from time to time with or without notice. Rewards Points may be redeemed for prizes only available through the Rewards Program. Continued access and use of the Rewards Program and participation in programs associated with the Rewards Program after any changes to the Terms constitutes your acceptance of the revised Terms then in effect. The Rewards Program website and mobile application may state the difference between redeemable Rewards Points and lifetime Rewards Points, where only redeemable Rewards Points may be used to redeem for prizes, enter sweepstakes, participate in auctions, or spend on experiences.

No purchase necessary to earn Rewards Points. Rewards Points designated as earnable with purchase (e.g., an offer of 5000 Rewards Points for purchasing a Junior Power Pack membership, an offer of 200 reward points per home game during the 2024 season for purchasing a concession item, an offer of 5000 reward points for 1919 Kitchen & Tap purchase, 10,000 points per month) can also be earned by a free alternative method of entry. To earn those points without making a purchase, hand print the names of the redemption opportunities you wish to earn, along with the information associated with the Rewards Member account; full name, phone number, email address, and zip code on a piece of paper and mail it in an envelope with correct postage to: Green Bay Packers, Attn: Packers Perks, 1265 Lombardi Ave., Green Bay, WI 54304. All entries become the property of the Club. Club is not responsible for illegible, late, lost, or incomplete entries, which will be disqualified. Following receipt of a valid entry by the Club, the corresponding Rewards Points will be processed and added to that Rewards Member's account.

 

6. REDEEMING POINTS FOR REWARDS

 

Subject to Club's rights to add, delete, or otherwise make changes to the Rewards Points structure as more fully expressed in the following section, Rewards Points may be redeemed for merchandise, experiences, auction items and other items of value, as determined by Club (collectively, the "Rewards") and from time to time, updated and presented within the Rewards Program. Rewards Points redeemed for Rewards will be subtracted from the Account of the Rewards Member at the time the Rewards Member requests a Reward (the "Reward Redemption"). Rewards Members can view the present Reward options and the points required to redeem for the Reward by visiting the Rewards Program website (www.packersperks.com) or the mobile application. Prizes are non-transferable.

If a Reward needs to be shipped, each redeeming Rewards Member is solely responsible for ensuring that his or her shipping address is correct in his or her Account profile prior to the Reward Redemption. Shipping and handling charges are included in the Rewards Points value required for the Reward Redemption. Club's obligation regarding delivery of a Reward is satisfied upon shipment of the selected Reward to the address identified in the Rewards Member Account as of the date of Reward Redemption. Club is not responsible for lost or stolen Reward(s) shipments and will only be responsible for non-receipt of Rewards in instances of shipment to an address different than the one in the user's Account profile as of the date of Reward Redemption. Rewards Members must allow reasonable time for shipment of a selected Reward.

Except as expressly provided herein, Rewards Points may not be exchanged or redeemed for cash, or other goods and services.

Once Rewards Points have been redeemed for a Reward or have expired subject to the terms below, such Rewards Points are no longer valid for any subsequent redemption and they may not be returned or refunded to a user's Account, except in the Club's sole discretion. The availability of any Reward or item(s) offered in the Rewards Program are subject to availability and may change at any time, without notice, in the sole discretion of Club. Rewards may be available only in limited quantities and will be distributed on a first-come, first-served basis. Rewards Members should regularly consult the Rewards Program for updates about Reward availability. All Rewards are provided "as is" with no warranty, representation or guarantee, either express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the Rewards, including, without limitation, its quality, merchantability or fitness for a particular purpose. The descriptions of Rewards are believed to be correct. Item depictions are solely illustrative and may not resemble the actual item Rewards Members receive. Rewards are final and cannot be refunded or exchanged.

Club will not have any responsibility for

1. any printing, production, typographical, mechanical, or other errors regarding earning, redemption, or accumulation of participation credit or any other aspect of the Rewards Program,

2. any delay or failure to credit your Account, or

3. any failure to provide Rewards Program communications.

 

7. CHANGES TO REWARDS POINTS AND REWARDS PROGRAM

 

The Rewards Points Program and structure are subject to modification, limitation, or elimination at any time, with or without notice, in Club's sole discretion, including, without limitation, the right to establish additional means of accruing Rewards Points, the right to modify and delete any or all of the recognized means of accruing Rewards Points existing at any given time, the right to change the Rewards available and their values, the right to amend the Rewards Redemption (defined below) terms, the right to exclude specific types of transactions from Rewards Points eligibility, and the right to terminate the Rewards Program altogether. Additionally, Club reserves the right to invalidate Rewards Points from an Account without notice if it determines in its sole discretion that such Rewards Points were improperly credited to such user's Account or were obtained fraudulently or otherwise in violation of the Terms.

 

8. REWARDS YEAR AND EXPIRATION OF REWARDS POINTS

 

Each Year of the Rewards Program shall begin on or after 10:01 am CT on July 31 and shall end at 10:00 am CT on July 31, unless otherwise determined by Club ("Rewards Year"). Unless otherwise determined by the Club, Rewards Points earned in a given Rewards Year shall automatically expire at 10:00 am CT on the last day of the following Rewards Year.

To illustrate, if a Rewards Member accumulates Rewards Points from July 31, 2024 - July 31, 2025, then those Rewards Points would expire on or after 10:01 am CT July 31, 2025.

Once Rewards Points expire, they may no longer be redeemed and will be immediately forfeited.

 

9. REWARDS PROGRAM PROMOTIONS AND EXPERIENCES

 

The Rewards Program website (www.packersperks.com) will explain Rewards Member benefits and specific promotion and experience details.

Rewards Member benefits, promotions, Rewards Program updates, and Account-based operational messages will be communicated to Rewards Members via email and disclosed on the Rewards Program website and mobile applications.

The specific terms of Rewards Program promotions and experiences will be disclosed at the time of the offering.

All Rewards which include Rewards Members participation in an actual event or experience may be cancelled, rescheduled, or otherwise modified without prior notice. If an event or experience is cancelled, rescheduled, or otherwise materially modified, the Rewards Member who redeems the Reward shall have the option to either accept the substituted Reward or have the applicable number of Rewards Points restored to the Account of the Rewards Member, and the option selected will be the sole and exclusive remedy available to the Rewards Member.

 

10. AUCTIONS

 

Rewards Members who redeem or attempt to redeem his or her Rewards Points through an auction ("Bidders") do so subject to the following terms and conditions:

A Bid is a Contract: Bidders that place a bid in an auction enter into a binding contract with Club. Once the auction has ended and a winning bid is designated ("Winning Bid"), as set forth below, Club has full authority to subtract Rewards Points equal to the Winning Bid from the Bidder's Account.

Bidding Process: Rewards Members may not place a bid in an amount greater than the number of Rewards Points they have accumulated in his or her Account. The Winning Bid shall be designated at the close of bidding for each Reward, and shall be designated at the sole discretion of Club. No Rewards Points will be deducted from any Account until after the auction has closed for a given Reward.

Winning Bid: The Bidder whose bid is designated as the Winning Bid ("Winning Bidder") will receive an email notification after the close of the auction, notifying the Winning Bidder of the item(s) he/she has been awarded and the Winning Bid amount(s). Rewards Points will be deducted from the Account of the Winning Bidder immediately upon close of any auction. If the Winning Bidder's Account has an insufficient number of Rewards Points at the time the auction closes, Club will award the item(s) to the Bidder with the next highest bid who has a sufficient number of Rewards Points. The Winning Bidder agrees to abide by the Terms and all other Club policies and procedures that coincide with receiving a Reward

Withdrawal and Adjustment of Item(s): From time to time it may become necessary to withdraw item(s) from an auction after they are listed. Club reserves the right to do so at any time, for any reason or no reason, before or during the auction. Club reserves the right to reject any and all bids in its sole discretion. No adjustment will be made after the auction has ended and/or Rewards have been awarded.

Interruption of Service: Club is not responsible for any interruption in service, errors, and/or omissions to the auction or Rewards Program, whether caused by Club or otherwise. Club does not guarantee continual, uninterrupted or error free service or use of the Rewards Program during the auction. Bidders acknowledge that auctions are conducted electronically and rely on hardware and software that may malfunction without warning. Club, in its sole discretion, may void any auction, temporarily suspend bidding and refuse to award any Reward item(s) that were affected by any malfunction.

Termination of Auction: Club reserves the right to alter or terminate any auction, at any time for any reason, at its sole discretion. The decisions of Club with respect to any auction are final.

 

11. REWARDS PROGRAM COMMUNICATIONS

 

By enrolling and participating in the Rewards Program, you are opting in to receive Rewards Program communications sent by email.

You may choose to opt-out of receiving electronic communications containing marketing messages by unsubscribing from marketing communications.

If you unsubscribe from receiving Rewards Program communications, Club reserves the right to send you Rewards Program information until you terminate your participation in the Rewards Program.

You may choose to opt-in to mobile communications at a future date by accessing your Account profile preferences and checking the option for communications.

 

12. REWARDS MEMBERS’ OBLIGATIONS AND REPRESENTATIONS

 

By enrolling in the Rewards Program, or by participating in the program, you are expressly agreeing to be bound by these Terms and you agree not to misuse Rewards Program privileges that is detrimental to Club or the Rewards Program, including without limitation: having multiple Accounts; making purchases on behalf of other Rewards Members; participating in purchasing or redemption fraud; or using any robot, spider, or other automatic device or manual process to transact with or monitor the Rewards Program.

As a Rewards Member, you agree to comply at all times, and are bound by, these Terms and all laws, rules, and regulations that are applicable to a Rewards Member. You hereby acknowledge that a Rewards Member may only participate in the Rewards Program if and to the extent that such participation is permitted by all applicable laws, rules, and regulations, and that registration is an application for enrollment that is subject to Club's acceptance and the termination provisions of these Terms. Club may refuse at any time to enroll an applicant, or to restrict, modify, or terminate a Rewards Member's participation in the Rewards Program without liability.

 

13. TERMINATION

 

Club may, without notice and in its sole discretion, terminate an Account at any time for any reason, which may include, but is not limited to:

1. a violation of the Terms;

2. misrepresentations of any information or any misuse of the Rewards Program,

3.evidence of fraud, abuse or suspicious activity;

4. violation of any federal, state, or local law or regulation in connection with the use of the Rewards Program; or

5. taking any action that is detrimental to the Rewards Program as may be determined by Club in its sole discretion.

You may terminate your Account at any time by

1. emailing [email protected] or any other email account designated by Club from time to time, or

2. if available, unsubscribing via the electronic method specified and made available by Club. To terminate an Account the Rewards Member must include his/her registered email address and full name. Your Account will terminate within a reasonable period of time after receipt of termination request.

If your Account is terminated by you or Club, all Rewards Points in your Account will be forfeited immediately upon termination. If you reapply for membership at a later date, you will not recover any Rewards Points forfeited from your previous membership Account.

 

14. PRIVACY POLICY AND RESTRICTING ACCESS

 

The privacy policy for the Rewards Program ("Privacy Policy") is set forth by a link within the Rewards Program website (www.packersperks.com). By enrolling and participating in the Rewards Program, you are agreeing that Club may use certain information provided by you as described in these Terms.

Rewards Members are responsible for maintaining the confidentiality of his or her Account and password and for restricting access to such Account. Additionally, Rewards Members agree to accept responsibility for all activities that occur under the Account or password of the Rewards Member.

 

15. LIMITATIONS OF LIABILITY AND RELEASE OF CLAIMS

 

None of Club and its parent companies, affiliates (including the National Football League and its member professional football clubs), subsidiaries, suppliers, partners, representatives, agents, successors, assigns, employees, officers, owners, members, directors and sponsors (the "Released Parties") will have any responsibility or liability for any claim, loss, injury, damage, delay, accident, cost or expense (including, without limitation, attorneys’ fees and costs ensued), nor for any incidental, indirect, special, punitive, exemplary, or consequential damages (collectively, "Losses and Damages" ), directly or indirectly arising from

1.these Terms,

2. the Rewards Program, the website, or the mobile application,

3. any failure, delay or decision by Club or any of the Released Parties in administrating the Rewards Program,

4. any unauthorized use of an Account or any breach of security beyond the reasonable control of Club or any of the Released Parties,

5. any offer, representation, statement, or claim about the Rewards Program made by any Released Party or any other person or entity, or

6. the purchase, redemption for or use of any Rewards, including all Reward Redemptions, whether made or available by Club, one of the Released Parties, or any other person or entity, or otherwise. The foregoing limitations of liability will apply whether or not the alleged Loss or Damage is based on contract, negligence, tort, strict liability, or any other basis even if any of the Released Parties have been advised of or should have known of the possibly of such Losses and Damages, and without regard to the success or effectiveness of other remedies.

IN NO EVENT WILL THE RELEASED PARTIES’ COMBINED AGGREGATE LIABILITY FOR ANY CAUSE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH ANY OF THE MATTERS DESCRIBED ABOVE EXCEED TWENTY-FIVE UNITED STATES DOLLARS (U.S. $25.00).

By participating as a Rewards Member, you hereby agree:

1. to release the Released Parties from any and all Losses and Damages incurred with respect to the issuance, receipt, possession, and use or misuse of any Rewards,

2.under no circumstances will you be permitted to obtain Rewards for, and you hereby waive all rights to claim, punitive, incidental, consequential, special or any other Loss or Damage, other than for actual out-of-pocket expenses,

3. all causes of action or claims arising out of or connected with the Rewards Program, or any Reward, will be resolved individually, without resort to any form of class action, and

4. any and all claims, judgements, and awards for Losses and Damages, or otherwise, will be limited to actual out-of-pocket costs incurred.

By participating in the Rewards Program, including without limitation any contest, sweepstakes, or accepting a prize, or any combination of the foregoing, you as a Rewards Member agree to defend, indemnify, and hold harmless the Released Parties from and against all claims, demands, losses, liabilities, third party actions, damages (including damage to computers caused by viruses), costs and expenses (including reasonable attorneys' fees and disbursements) based upon or arising out of, directly or indirectly, from the acceptance, possession, or participation in any Rewards Program related activity, including without limitation claims arising out of or relating to the Rewards Program, the Privacy Policy, or these Terms and Conditions.

 

16. NO WARRANTY

 

THE REWARDS PROGRAM, WEBSITE, AND THE MOBILE APPLICATION ARE PROVIDED "AS IS" WITHOUT WARRANTY OR REPRESENTATIONS OF ANY KIND. CLUB HEREBY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND WHATSOEVER, WHETHER WRITTEN OR ORAL, EXPRESS, IMPLIED, STATUTORY, OR ARISING BY OPERATION OF LAW, COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH RESPECT TO THE REWARDS PROGRAM AND THE WEBSITE AND MOBILE APPLICATION.

REWARDS POINTS OWNERSHIP AND OTHER RESTRICTIONS

Rewards Points do not constitute property, do not entitle a Rewards Member to a vested right or interest, and have no cash value. As such, Rewards Points are not redeemable for cash, transferable or assignable for any reason. The sale, barter, transfer or assignment of any accumulated Rewards Points, other than by Club, is strictly prohibited. Any Rewards Points which Club deems in its sole discretion to have been transferred, sold, bartered or assigned in violation of these Terms may be confiscated and/or cancelled.

 

17. DISPUTES AND GOVERNING LAW

 

Any and all controversies, disputes, or claims arising out of or relating to the Rewards Program, the Privacy Policy, or these Terms and Conditions shall be resolved exclusively by binding arbitration before a single arbitrator with such arbitration to be conducted in Brown County, Wisconsin in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The party initiating such arbitration shall be responsible for any and all administrative fees, including but not limited to filing fees and proceed fees, and the parties shall equally divide the arbitrator's fees. In connection with such arbitration, and all other disputes, Club and the Released Parties, on the one hand, and the Rewards Member, on the other, hereby agree as set forth above that such claim or cause of action shall be resolved individually, without any form of class action. Both the Rewards Member and Club hereby waive their right to a jury trial in connection with any such proceeding. Further, in any such dispute, under no circumstances will the Rewards Member or Club be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and the Rewards Member and Club further waive all rights to have damages multiplied or increased. These Terms and any dispute arising out of these Terms, including without limitation the Rewards Program, Rewards, and Rewards Redemption, will be governed by the laws of the state of Wisconsin, without regard to the principles of comity or choice of law provisions.
